Open Question: collection agency, employer overpayment, Canadian laws and credit protection?

Thursday, June 5th, 2008

Hello from Canada,

I have been dealing with my past employment agency telling me I that have received an overpayment on vacation pay after termination (approx $250). Now, I don’t really know if this is actually true.

I now have a collection agent sending me notices in the mail. I have requested the agent to provide me with the documentation which states the overpayment. I am still kind of interested in how the agent can threaten my credit for this. I did not sign anything as a debtor.

At what point in the process can the agent put a bad credit on my file, would bad credit occur after a court decision? Doesn’t the agent have to provide me with documentation on this overpayment? I never made the mistake, yet I would still consider paying back the amount.

When I asked the agent for proof of over payment, he rudely informed me that, “Call the employer and get it from them, I have been in this industry before you were born.”

How can this affect my credit? When would it?
thnx
